Real Estate Transactions

Real estate transactions cover the legal side of buying, selling, leasing and mortgaging property.

What this covers

  1. 01Agreements to sell and sale deeds
  2. 02Leases and licence agreements
  3. 03Title checks and searches
  4. 04Stamp duty and registration
  5. 05Mortgage and loan documentation

How it generally works

A sale of immovable property worth one hundred rupees or more must be made by a registered instrument under the Transfer of Property Act, 1882 and the Registration Act, 1908, with stamp duty paid at the rates applicable in the state.

Before buying, it is usual to check the seller's title, encumbrances, approvals, dues and any pending litigation.

In Delhi, the type of land and property (freehold, leasehold, or in an authorised or unauthorised colony) affects what documents and permissions are needed.
