Builder–Buyer Disputes

Builder–buyer disputes arise between home buyers and developers over delay, defects, changes to plans and refunds.

Disputes with developers over delayed or defective flats and plots, including before the real estate regulator (RERA).

What this covers

  1. 01Delay in handing over possession
  2. 02Refund of amounts paid with interest
  3. 03Structural defects and deficiencies
  4. 04Unilateral changes to layout or specifications
  5. 05Complaints before the real estate regulator and consumer commissions

How it generally works

The Real Estate (Regulation and Development) Act, 2016 (RERA) requires most projects to be registered with the state regulatory authority, which in Delhi is the Delhi RERA. Buyers can complain to the authority, which can order refunds, interest and compensation.

Buyers may also approach consumer commissions for deficiency in service. The choice of forum depends on the relief sought and the facts.

Agreements for sale, allotment letters and payment records are central evidence in these disputes.
