Mediation

Mediation is a voluntary process in which a neutral mediator helps the parties reach their own settlement.

A neutral mediator helps the parties reach their own settlement.

What this covers

  1. 01Court-referred mediation
  2. 02Pre-institution mediation in commercial matters
  3. 03Private mediation
  4. 04Mediation in family disputes
  5. 05Recording and enforcing settlements

How it generally works

The Mediation Act, 2023 provides a framework for mediation in India. Courts can refer pending cases to mediation, and section 12A of the Commercial Courts Act, 2015 requires pre-institution mediation before most commercial suits.

Mediation is confidential, and the mediator does not decide the dispute. If the parties settle, the agreement is recorded in writing.

A settlement reached in mediation can be made binding and enforceable.
