An Additional Sessions Judge in Delhi granted bail to a man in judicial custody on a charge of criminal conspiracy in a serious sexual-offence case. Advocate Pravesh Dabas appeared for the applicant.
Without commenting on the merits, the court took into account that:
- the applicant had been in custody since 31 October 2020;
- the chargesheet had been filed; and
- his mother was suffering from final-stage cancer.
He was released on a bail bond of ₹40,000 with one surety.
For the applicant it was argued that custodial interrogation was no longer needed once the chargesheet had been filed, that he was not named in the FIR, and that he had been arrested only on the basis of a co-accused's disclosure statement.
